The Visa Macau Promotion 2012-2013 ("Promotion") consists of offers from merchants participating in the Promotion ("Merchant Offers") only.

The period of the Promotion is from December 1, 2012 until April 30, 2013 (both dates inclusive) ("Promotion Period").

The Promotion is offered to Visa cardholders who are 18 years of age or above ("Cardholders") and settle their payment transactions with a valid, non-delinquent and good financial standing Visa card issued in the Macau Special Administrative Region of the People’s Republic of China ("Macau") or overseas countries and territories during the Promotion Period only.

Cardholders of Dual Currency cards must select to use the Visa Network in order to be eligible for the Promotion.

All Merchant Offers are only valid at the designated branches of the participating merchants.

Cardholders must present valid, non-delinquent and good financial standing Visa cards before placing orders and settle payments with such cards in order to enjoy the Merchant Offers.

All the Merchant Offers are available on a first-come, first-served basis and while stocks last; and are also subject to actual availability of same.

To the fullest extent permitted by law, Visa shall not be liable to any person for any personal injury, death, loss, damage or liability (whether direct, indirect or otherwise) arising from or in connection with the Merchant Offers or the Promotion, including, but not limited to, any loss of income, profits or goodwill caused to Cardholders arising from the participating merchants’ failure to provide the Merchant Offers. To the fullest extent permitted by applicable laws, Visa offers no warranty or representation whatsoever, express, implied or statutory, in relation to the Promotion and the Merchant Offers (including, but without limitation, the discounts, privileges, gifts and services provided by all participating merchants or other service providers or in relation to the merchantable quality or fitness for purpose in relation to the gifts whatsoever).

Merchant Offers of some specific participating merchants cannot be used in conjunction with other offers, discounts or privileges. Please enquire with the participating merchants for details.

Visa and its agents and their respective retained service providers will only keep such personal data for so long as they are required for the purposes stated in the terms and conditions herein. Visa and its agencies and their respective retained service providers will treat all personal data collected from the Cardholders in confidence. The entire Cardholders’ rights under the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) and the Macau Personal Data Processing and Protection Law (no. 8/2005) shall be recognized by Visa and its agencies and their respective retained service providers at all times.

All questions and disputes regarding the Promotion will be determined at the sole discretion of Visa. Visa’s decisions on all matters relating to the Promotion are final and binding on all the Cardholders. No objection or correspondence will be entertained. All personal data collected pursuant to the Promotion which is not retained for sending marketing material will be automatically destroyed within 24 months after the end of the Promotion. Registration data and other information about Cardholders are subject to Visa’s privacy policy. To the fullest extent permitted by law, Visa reserves the right: – to amend, delete or add to any of the terms and conditions herein at any time with notice but without reasons. Visa may give advance notice to Cardholders in the manner it deems appropriate in such an event. Cardholders may obtain updated version(s) of the terms and conditions herein, if any, by logging on to the Visa Website. For the avoidance of doubt, the exercise by Visa of any of its foregoing rights shall not entitle any eligible Cardholders to claim for compensation against Visa or any of its agencies or their respective retained service providers.

In the event of any discrepancy between the Chinese and English versions of these Terms and Conditions, the English version shall prevail.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.
